2017 Actor sexual abuse case: Kerala HC orders sessions judge to give memory card ‘leak’ probe report to survivor | Thiruvananthapuram News

The Kerala High Court on Wednesday directed the district and sessions judge in Ernakulam to hand over a copy of its report pertaining to the alleged unauthorised access to the memory card to the survivor. Actor Dileep is one of the accused in the 2017 sexual abuse case.

The court in December last year had ordered the district judge to conduct a fact-finding inquiry on the allegation with regard to the unauthorised access to the memory card. The high court had allowed the district judge to seek the assistance of any agency and stated that the judge shall proceed as per the CrPC provisions if commission of any offence is revealed in the inquiry. It had granted one-month time for the probe.

The high court had issued the directive to the district court following a petition from the actor. She had alleged that the memory card was accessed more than once when it was in the custody of the court.

The high court had found that on three occasions, the memory card was connected to computer systems installed with devices capable of copying or transferring the electronic record or mutating the contents. “The necessary conclusion would be that we failed to protect the victim’s interest, which resulted in the violation of her fundamental constitutional right. The victim alleges that the contents of the video footage were copied and transmitted. The emotional and psychological harm being suffered by the victim is beyond imagination,’’ the high court had noted in its earlier order.

Ordering the probe, the high court had stated that an inquiry into the allegation that somebody unauthorisedly accessed the memory card, and copied and transmitted the contents of it will only remove the cloud on the judicial system. It will only maintain the majesty of the judicial process and the purity of the legal system. The offences alleged pertain to public justice. Therefore, the obligation of the system is more profound, said the court.
